In last month’s senate hearing, Jinky Sta. Isabel pleaded for the playing of the audio recording because she believes that audio is the key in proving his husband’s innocence.
Jinky told the senators that she is willing to go to jail as consequence for playing the audio. Jinky wants the public to hear how Supt. Dumlao tried to convince her to dance along with his cover-up plan and save their asses from the Jee Ick Joo fiasco.
The senate did not grant her request because this is illegal under the anti-wiretapping law.
REPUBLIC ACT No. 4200, popularly known as the Anti_Wiretapping Law is defined as:
AN ACT TO PROHIBIT AND PENALIZE WIRE TAPPING AND OTHER RELATED VIOLATIONS OF THE PRIVACY OF COMMUNICATION, AND FOR OTHER PURPOSES.
Section 1. It shall be unlawful for any person, not being authorized by all the parties to any private communication or spoken word, to tap any wire or cable, or by using any other device or arrangement, to secretly overhear, intercept, or record such communication or spoken word by using a device commonly known as a dictaphone or dictagraph or dictaphone or walkie-talkie or tape recorder.
Direct participants to the wiretapping and anyone who aids, permits, or causes the violation are, upon conviction, punished by imprisonment of not less than six months or more than six years. If the offender is a public official at the time of the offense, he shall be penalized with perpetual absolute disqualification from public office. If the offender is a foreigner, he shall be subject to deportation.
However, Jinky Sta. Isabel took to Facebook and posted the audio recording between her and Supt. Rafael Dumlao III on February 6, 2017, despite the threats of going to prison for making the explosive audio recording public.
